Booking Terms and Conditions


  1. CHANGES TO THE EVENT

    • The Jonesway Theatre reserves the right to make alterations to the published event where necessary.

  2. REFUNDS AND EXCHANGES

    • Under Australian Consumer Law, if an event takes place the ticket holder generally has no right to a refund.

      • The Jonesway Theatre will not issue a refund for a lost ticket. 

      • A change in personal circumstances does not entitle a ticket holder to a refund.

    • Tickets may be exchanged for other performance times of the same event, subject to availability.

    • Where an event is cancelled or rescheduled, subject to clause 3, a ticket holder will be entitled to claim a refund.

    • Where there is a significant change to an event,  as required by Australian Consumer Law, you will be entitled to claim a refund.

      1. A ‘significant change’ to an event is a change which makes the event materially different to one that purchasers of the ticket could reasonably expect.

    • Unless required by law, booking fees are not refundable.

  3. CANCELLED OR RESCHEDULED EVENT

    • NOTIFICATION: In an instance where an event is cancelled or rescheduled, The Jonesway Theatre will make  reasonable efforts to notify  ticket holders using the details provided at the time of purchase.

      • It is the ticket holder's responsibility to inform The Jonesway Theatre of any change to the contact address, telephone number or email address that was provided at the time of purchase.

    • CANCELLATION: If an event is cancelled in full (and not rescheduled), the ticket holder will be refunded for the price of their tickets.

    • RESCHEDULED: If an event is rescheduled, tickets will be valid for the new date subject to availability. 

      1. If a ticket holder notifies The Jonesway Theatre before a specified deadline (which will be a reasonable period from the time the rescheduled event date is announced) that they are unable to attend the rescheduled event, the ticket holder will be entitled to  cancel their order and obtain a refund of the price of their tickets. 

      2. Failure to notify The Jonesway Theatre by any reasonable specified deadline that a ticket holder is unable to attend the rescheduled event will be deemed to be a reconfirmation of tickets for the rescheduled event, and the ticket holder will no longer be entitled to a refund as a result of the reschedule (unless required by law). 

      3. For the avoidance of doubt, no refunds will be issued until the new date is announced (which will be done within a reasonable timeframe) to allow The Jonesway Theatre  to make alternative arrangements for the rescheduled event.

  4. GOVERNMENT-DIRECTED CLOSURES

    • If an event is cancelled or rescheduled due to government directives, The Jonesway Theatre will follow the standard terms and conditions that were applicable at the time of purchase.

  5. RESALE OF TICKETS

    • Ticket holders may not resell or transfer a ticket without The Jonesway Theatre’s permission. 

    • Any resale or transfer (or attempted resale or transfer) of a ticket in breach of this condition is grounds for cancellation of said ticket.

  6. VOID TICKETS

    • Any ticket obtained in breach of these Terms and Conditions shall be void and all rights conferred or evidenced by such ticket shall be void.

    • Any person seeking to use such a void ticket in order to gain entry to an event may be considered to be a trespasser and may be ejected and liable to legal action. 

    • Void tickets are non-refundable.

  7. CONDITIONS OF ADMISSION AND ATTENDANCE

    • The Jonesway Theatre management reserves the right to refuse a ticket holder’s admission to the venue in reasonable circumstances including, but not limited to, health and safety, licensing or where a ticket is void.

    • The Jonesway Theatre management reserves the right to request that ticket holders leave the venue at any point on reasonable grounds and may take any appropriate action to enforce this right.

    • No refunds will be given to ticket holders who are refused entry or ejected due to their own behaviour.

  8. RESTRICTIONS AND PROHIBITIONS

    • By attending an event at The Jonesway Theatre, ticket holders consent to filming and sound recording of themselves as guests of the event. Use of this media may be used for future marketing of the event.

    • Ticket holders shall not display or distribute (whether for free or not) at the event any sponsorship, promotional or marketing materials without express permission from The Jonesway Theatre

    • Smoking is not permitted in The Jonesway Theatre.

    • The following are not permitted within The Jonesway Theatre: animals (with the exception of assistance animals), laser pens, fireworks, flares, smoke bombs, food and drink from outside the premises, any item which may be interpreted as a potential weapon, illegal substances.

    • The Jonesway Theatre management reserves the right to conduct security searches and to confiscate any item which, in reasonable opinion, may cause danger or disruption to other patrons, or is one of the items not permitted in the venue, as listed in clause 8.4.

    • Every effort shall be made to admit latecomers to the event at a suitable break in the programme, at the discretion of management.

  9. HEALTH AND SAFETY

    • Ticket holders must comply with all relevant statutes, safety announcements and regulations whilst attending the event. If ticket holders have any special requirements or concerns about any special effects which may be featured at the event, notice should be provided when purchasing tickets.

    • Special effects may include, without limitation, sound and lighting effects including strobing.

      1. In line with clause 2.1, ticket holders will not be provided with a refund if they cannot attend an event in which there are features or themes that may cause them distress.

  10. WAIVER

    • If The Jonesway Theatre delays or fails to enforce any of these Terms and Conditions, it shall not mean that they have waived their right to do so.

  11. GOVERNING LAW AND JURISDICTION

    • The provisions of these Terms and Conditions are governed by the laws of Western Australia, Australia.
